Terms of Service
These are the rules for using Poze. Downloading, opening or using the app means you accept them. They are a contract, so they are written more carefully than the rest of this site — but we have tried to keep them readable, and to say plainly which parts limit your rights.
1. The agreement
These Terms are between you and the operator of Poze ("we", "us"), a company incorporated in the Hong Kong Special Administrative Region. Together with the Privacy Policy and the Content Policy, which are part of them, they govern your use of the Poze app and this website (the "Service").
Our registered entity details are published on the App Store and Google Play listings for Poze, which identify the developer of record. For anything you need from us, support@yes366.com reaches a person.
1.1 Eligibility
- You must be at least 16 years old. If your country sets a higher minimum for using a service like this without a parent, that age applies to you.
- If you are using Poze for a company, organisation or client, you confirm you are authorised to accept these Terms on its behalf, and "you" means both you and it.
- You must not be barred from using the Service under the law that applies to you, and must not be on a relevant sanctions list.
1.2 Changes to these Terms
- We may change these Terms. The current version always lives at this URL with its effective date at the top.
- Material changes are announced in the app before they take effect, with at least 14 days' notice where we can reasonably give it.
- Continuing to use the Service after a change takes effect means you accept it. If you do not, stop using the Service and, if you like, delete your account — you will not be charged again after cancelling.
- Where a change reduces what you already paid for, it will not be applied to a subscription period you have already bought.
2. The Service
- Poze generates images, video and audio from material and instructions you supply, using machine-learning models operated by us and by third parties.
- Availability varies by country, by platform and over time. Some features may not be offered where you are.
- You are responsible for making sure your use of Poze is legal where you are. We cannot advise you on that.
- The Service is provided as is and as available. We do not promise it will be uninterrupted, error-free, or that a particular model stays available.
- Generative models are probabilistic. The same inputs can produce different results, and a result may be wrong, odd, or simply not what you pictured. That is the nature of the technology, not a defect in the Service.
2.1 Changes to the Service
We may add, change, or retire features and models. If we retire something central to a paid plan, we will give reasonable notice and, where the change materially reduces what you paid for, offer a pro-rata remedy or the ability to cancel without penalty.
3. Your account
3.1 Guest and linked accounts
- You can use Poze without registering. A guest account is tied to the device it was created on. It survives reinstalling the app, but it does not move to a new device.
- When you link a Google, Apple or email account, we merge your guest work, avatars, voices and credits into it. If both sides already hold data, we ask you which way to combine them.
- Once merged, a merge cannot be undone.
3.2 Your obligations
- Give accurate registration information and keep it current.
- Keep your credentials and your device secure. Activity under your account is your responsibility, unless it results from our own failure.
- Do not impersonate anyone, or pick a nickname or avatar designed to suggest you are someone you are not.
- Do not sell, rent, lend or transfer your account, and do not let anyone else use it as if it were theirs.
- One person, one account. Do not create additional accounts to get around limits, free quota or enforcement.
- Tell us at support@yes366.com promptly if you believe your account has been compromised.
4. Content
Three different things are involved, and they are owned differently: what you put in (Inputs), what comes out (Outputs), and the material we supply (Poze Materials — templates, preset avatars, official voices, icons, mascots, sample media).
4.1 Your Inputs stay yours
Uploading something does not transfer ownership of it. You keep whatever rights you had in it.
4.2 Outputs are yours
- As between you and us, you own the Outputs you generate, and you may use them personally or commercially, subject to these Terms and the Content Policy.
- We claim no ownership of your Outputs and do not licence them to anyone else.
- Generative models can produce similar results for different people from similar prompts. We therefore cannot promise your Output is unique, and cannot promise it is free of third-party rights — particularly if you prompted for a style, character or likeness that belongs to someone.
- In some countries, material generated by a machine with little human input may not attract copyright at all. Whether your Output is protectable is a question of local law, not something we can grant you.
4.3 The licence you give us
So the Service can function, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, copy, transcode, transmit and display your Inputs and Outputs, and to send them to the model provider running the model you chose. This licence exists only to operate the Service for you, to keep it safe and lawful, and to comply with legal obligations. It ends when you delete the content, subject to the backup window and legal retention described in the Privacy Policy.
We do not use your private Inputs or Outputs to train models. If that ever changes we will ask for separate, specific, opt-in consent.
If you publish something to the community, you additionally grant us a licence to display it in the app and to feature it in material promoting the Service, with attribution to your profile. You can unpublish at any time, and we will stop new display; copies already distributed or cached outside our control may persist.
4.4 What you promise about your Inputs
For everything you upload, you confirm that:
- You own it, or you have the rights and permissions needed to upload it and to have it processed as described here.
- If it shows a person, you have that person's clear permission to use their likeness this way — and, for voice cloning, the voice is your own.
- It does not infringe anyone's copyright, trade mark, privacy, publicity or other rights.
- It does not breach the Content Policy.
- You have complied with any law that applies to collecting or sharing it, including where consent was legally required.
4.5 Poze Materials
- Templates, preset avatars, official voices, icons, mascots and sample media are licensed to you for use inside the Service, to produce Outputs.
- You may use an Output that incorporates Poze Materials commercially, on the same terms as any other Output.
- You may not extract, redistribute, resell or sublicense Poze Materials as standalone assets, or use them to build or train a competing service.
- We may modify or withdraw any Poze Material. If one is withdrawn, Outputs you already made with it are unaffected.
4.6 Sharing Outputs elsewhere
- You are free to post Outputs on other platforms. Their rules then apply, including any obligation to label AI-generated content — several platforms now require this.
- If an Output is derived from a template, a preset avatar or another user's published work, credit accordingly where the destination platform expects it.
- Do not present an Output as an authentic photograph, recording or news footage.
4.7 AI marking
Outputs carry a marking identifying them as AI-generated. A Pro subscription removes the visible badge. The embedded watermark and content provenance metadata are not removable, and you must not strip, obscure or tamper with them. Several jurisdictions require AI-generated media to remain identifiable, and this is how we meet that.
4.8 Removal
We may remove, restrict or refuse to process content that breaches these Terms or the Content Policy, that we are legally required to act on, or that presents a serious safety risk. Where we can, we tell you which rule was involved and how to appeal.
5. Credits, subscriptions and refunds
5.1 Credits
- Credits pay for generation. Cost varies by tool, model and settings — some models charge per second of output — and the exact cost is shown before you submit.
- If a job fails, or its result is blocked by moderation, credits are refunded automatically and the refund appears in your credit history.
- Cancelling a job that has not started yet refunds in full. Once generation has begun, a job that completes successfully is not refundable — including when you simply do not like the result.
- Credits are an allowance inside the Service. They are not money, not a stored-value instrument and not a security. They cannot be withdrawn, transferred, sold, or exchanged for cash, and they have no value outside Poze.
- Purchased credits do not expire while your account is active. Credits granted free — daily rewards, promotions, referrals — may carry their own expiry, which is shown when you receive them.
- Daily free runs reset at midnight in your device's time zone and do not roll over.
- We may adjust what a given generation costs as model pricing changes. Changes apply to future jobs, never retroactively, and the price is always shown before you commit.
5.2 Subscriptions
- Subscriptions are sold and billed by the App Store or Google Play, not directly by us. Your payment relationship for them is with that store.
- Subscriptions renew automatically until cancelled. You are charged within 24 hours before the start of each new period.
- Cancel at least 24 hours before renewal, in that store's account settings. Deleting the app does not cancel a subscription — this is the single most common misunderstanding, and it results in a charge you did not expect.
- Where a free trial is offered, billing begins automatically when it ends unless you cancel first. The app tells you the date the charge will fall. If you buy while a trial is running, the trial usually ends immediately — that is the store's rule, not ours.
- If a price changes, the store notifies you and, where required, asks you to consent before the new price takes effect.
- When a subscription ends, lapses or is refunded, Pro features switch off. Work you already created stays, and any watermark-free files you already exported stay as they are.
5.3 Refunds
- Refunds for purchases are handled by Apple or Google under their own policies. We cannot process them for you, and we cannot overrule a store's decision.
- If you believe a charge resulted from a fault on our side, write to us first. We will investigate, and where we are at fault we will make it right — by restoring credits or entitlements, or by supporting your refund request with the store.
- Statutory rights of withdrawal or cancellation, where your local law gives you them, are unaffected by anything in this section.
- Credits already spent on completed generations are not refundable.
6. Acceptable use
The Content Policy has the detail and forms part of these Terms. In summary, you must not use Poze to create, upload, publish or distribute content that:
6.1 Content prohibitions
- Sexualises a minor in any way, or depicts child sexual abuse. This is absolute.
- Is sexual or pornographic, or depicts nudity.
- Uses a real person's face, voice or likeness without their clear permission — including any depiction of a public figure, politician or celebrity.
- Is non-consensual intimate imagery, or places someone's face onto sexual content.
- Harasses, bullies, threatens or intimidates a person or group.
- Reveals private information about someone without consent — address, phone number, workplace, identity documents.
- Attacks people on the basis of race, ethnicity, national origin, religion, caste, sexual orientation, sex, gender identity, disability or serious disease.
- Promotes, glorifies or provides instructions for terrorism or violent extremism.
- Depicts gratuitous gore, graphic violence, or cruelty to animals.
- Encourages or glorifies suicide, self-harm or disordered eating.
- Is intended to defraud, deceive or manipulate — including fabricated news footage, election disinformation, fake identity or financial documents, and impersonation for gain.
- Provides dangerous medical, legal or financial advice presented as authoritative.
- Infringes copyright, trade marks or other intellectual property.
- Removes or obscures a watermark, credit or copyright notice from someone else's work.
- Advertises or facilitates regulated goods — drugs, weapons, explosives — illegal gambling, or human trafficking and sexual services.
- Is used in political campaigning or for state propaganda.
6.2 Technical prohibitions
- Accessing the Service by any automated means — scripts, bots, scrapers, emulators, modified clients — other than an interface we publish for that purpose.
- Creating multiple or automated accounts, or otherwise farming free quota, credits, referral rewards or promotional codes.
- Reverse engineering, decompiling or attempting to derive our source code, model weights or prompts, except to the extent that local law says you may.
- Circumventing, disabling or probing rate limits, request signing, moderation, entitlement checks or any other security mechanism.
- Penetration testing, load testing, or attacking the Service or its infrastructure without our prior written permission.
- Interfering with other users' use of the Service, or storing an unreasonable volume of data on it.
- Using the Service, or its Outputs, to build or train a competing model or service.
- Reselling, sublicensing or providing the Service to third parties as if it were yours, without our written agreement.
7. Moderation, enforcement and appeals
- Uploads, prompts and generated results pass through automated moderation. Blocked prompts are not charged; a job blocked at the output stage is refunded.
- Users can report content and block other users. Reports go to human review.
- Enforcement escalates with severity: blocking one job, removing content, limiting features, suspending the account, terminating it. Violations of the absolute prohibitions in §6.1 go straight to termination, and where the law requires it we preserve evidence and report to the authorities.
- Automated moderation makes mistakes. Every automated block can be escalated to a person — see the Content Policy for how.
8. Our intellectual property, and copyright complaints
8.1 Ours
The Poze name, logo, mascots, interface, icons, illustrations, documentation and software are owned by us or licensed to us. Nothing in these Terms transfers them to you beyond the limited licence in §4.5. You may not use our brand in a way that suggests endorsement or affiliation without permission.
8.2 Reporting infringement
If you believe content on Poze infringes your rights, email support@yes366.com with "Copyright" in the subject line and include:
- Your name, address and a contact email, and who you act for if not yourself.
- Identification of the work you say was infringed.
- Identification of the content on Poze, precisely enough for us to find it — a link, a post ID, or a screenshot with context.
- A statement that you believe in good faith the use is not authorised by the rights holder, its agent, or the law.
- A statement that the information is accurate and that you are authorised to act.
- Your signature, electronic or physical.
We investigate and remove content where the complaint is well founded. Filing a knowingly false complaint can expose you to liability.
8.3 Counter-notice
If your content was removed and you believe that was a mistake or that the use was authorised, reply with a counter-notice identifying the content, explaining why, and confirming the accuracy of what you say. Where appropriate we restore the content and put the parties in touch.
8.4 Repeat infringers
Accounts that repeatedly infringe are terminated.
9. Feedback
If you send us ideas, suggestions or bug reports, thank you — genuinely. We may use them without restriction, without compensation and without obligation to keep them confidential. Do not send us anything you consider secret or want paid for. This does not give us rights over any Input or Output you happen to attach; those stay governed by §4.
10. Third-party services and links
Poze links to and integrates with services we do not control — app stores, payment platforms, sign-in providers, model providers, and whatever a user happens to link to. We do not endorse them, we are not responsible for them, and their terms apply when you use them. If a third-party service becomes unavailable or changes, features that depend on it may change or stop.
11. Privacy
How we handle personal data is set out in the Privacy Policy, which forms part of these Terms. No transmission over the internet is perfectly secure; §11.5 of that policy says what we do about it and what we cannot promise.
12. Suspension and termination
12.1 By you
Stop using Poze whenever you like. To end the relationship entirely, delete your account in Settings — that is irreversible. Cancel any subscription separately in your app store; deleting the account does not cancel it.
12.2 By us
We may suspend or terminate your access, with notice where practicable and without it where the situation is serious, if you breach these Terms or the Content Policy, if we are legally required to, if your use presents a security or safety risk, or if we discontinue the Service in your region.
12.3 What happens then
- Access stops, and content that breached the rules stays down.
- Unused credits are not refunded on termination for breach, except where local law requires otherwise.
- If we discontinue the Service or terminate you without cause, we will refund unused purchased credits and the unused portion of a paid subscription period, so far as the app stores permit.
- Sections that by their nature should survive — content licences already granted for published work, §5.1 on the nature of credits, §8, §9, §13, §14, §15, §16 and §17 — survive termination.
13. Disclaimers
Read this section: it limits what you can rely on.
To the fullest extent permitted by law, the Service is provided as is and as available, without warranties of any kind, express or implied — including any implied warranty of merchantability, fitness for a particular purpose, title, or non-infringement.
In particular, we do not warrant that: the Service will be uninterrupted, timely or error-free; defects will be corrected; any specific model will remain available; Outputs will be accurate, original, suitable for any purpose, free of third-party rights, or protectable by copyright; or that moderation will catch every violation or never misfire.
Outputs are not advice. Do not rely on anything Poze generates as medical, legal, financial or safety information.
Some jurisdictions do not allow the exclusion of implied warranties. Where that is so, the exclusions above apply only as far as the law permits, and your non-excludable statutory rights — including consumer guarantees — are unaffected.
14. Limitation of liability
Read this section: it caps what we owe you.
- To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost revenue, lost goodwill, lost data, or business interruption — even if we were told such damage was possible.
- Our total aggregate liability arising out of or relating to the Service or these Terms will not exceed the greater of the amount you actually paid us for the Service in the 12 months before the event giving rise to the claim, or USD 100.
- These limits apply to every theory of liability — contract, tort, statute or otherwise — and survive any failure of an essential remedy.
Nothing here excludes or limits liability that cannot lawfully be excluded: death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability your local law does not permit us to limit. Some jurisdictions do not allow these limits; there, they apply only as far as the law permits.
15. Indemnity
You agree to indemnify and hold harmless us, our affiliates, and our respective directors, officers, employees, agents and partners from claims, damages, liabilities, losses and reasonable legal costs arising from: your Inputs or Outputs; your use of the Service; your breach of these Terms, the Content Policy, or any law; or your infringement of anyone's rights — including a claim that you used someone's likeness or voice without permission.
We will tell you promptly about any claim we seek indemnity for, and will not settle it without your consent, which you will not unreasonably withhold. This section does not apply where the claim results from our own breach or negligence, and it does not apply to consumers to the extent local law prohibits it.
16. Independent operation of these clauses
The disclaimers, liability limits and indemnity in §13 to §15 operate independently of one another and apply to all claims, regardless of the type of breach alleged. If one is held unenforceable, the others continue to apply.
17. Governing law and disputes
17.1 Talk to us first
Most disputes can be sorted out quickly. Before starting formal proceedings, please write to support@yes366.com describing the problem and what you want. We will engage in good faith for 30 days.
17.2 Governing law
These Terms are governed by the laws of the Hong Kong Special Administrative Region, without regard to conflict-of-laws rules.
17.3 Arbitration
If we cannot resolve a dispute within 30 days, it will be referred to and finally resolved by arbitration administered by the Hong Kong International Arbitration Centre under the HKIAC Administered Arbitration Rules in force when the Notice of Arbitration is submitted. The seat is Hong Kong, there is one arbitrator, the language is English, and the award is final and binding on both parties.
17.4 Exceptions
- Either party may seek injunctive relief from a court to protect intellectual property or confidential information.
- You may bring a qualifying claim in a small-claims court instead.
- If you are a consumer, nothing in this section deprives you of the protection of mandatory provisions of the law of your country of residence, or of your right to bring proceedings in your local courts where that law gives you it.
18. Other terms
- Entire agreement — These Terms, the Privacy Policy and the Content Policy are the whole agreement between us about the Service, and replace anything said before.
- Severability — If a provision is held unenforceable, it is modified to the minimum extent needed, or severed, and the rest stands.
- No waiver — Not enforcing a right straight away does not waive it.
- Assignment — You may not assign these Terms. We may assign them to an affiliate or in connection with a merger, acquisition or sale of assets.
- No third-party rights — No one other than you and us has the right to enforce these Terms.
- Notices — We give notice in the app or by email to the address on your account. You give notice by writing to support@yes366.com.
- Force majeure — Neither party is liable for failure to perform caused by events beyond its reasonable control.
- Language — These Terms are written in English. Any translation is provided for convenience, and the English version governs.
- App store terms — Where you obtained Poze from an app store, that store's terms also apply, and if they conflict with these Terms for that transaction, theirs prevail. Apple and Google are not parties to these Terms and are not responsible for the Service.
Governing law and arbitration follow the place of incorporation of the company that operates Poze: the Hong Kong Special Administrative Region. Consumers keep the protections of their own local law, as set out in §17.4.
